These Terms of Service ("Terms") govern your access to and use of AI Kungfu, available at aikungfu.app. AI Kungfu provides online AI video generation tools for creating kungfu, martial arts, Wushu, Tai Chi, action, and entertainment-style videos from uploaded images and prompts.

By accessing or using AI Kungfu, creating an account, uploading content, generating videos, or purchasing credits, you agree to these Terms. If you do not agree, do not use AI Kungfu.

1. Service Overview

AI Kungfu provides tools that may allow users to:

  • Upload one or more images as video generation inputs.
  • Enter prompts and select motion details for AI kungfu video generation.
  • Generate short AI videos using third-party AI models or infrastructure.
  • View, download, and manage generated outputs.
  • Purchase or use credits, plans, or other paid features if enabled.

AI-generated outputs are probabilistic and may vary by prompt, input quality, model availability, processing behavior, moderation rules, and technical conditions. We do not guarantee a specific creative result, generation speed, uptime, model availability, or commercial suitability.

2. Eligibility

You may use AI Kungfu only if you can legally enter into these Terms and comply with all applicable laws. You must be at least 13 years old, or the minimum age required in your jurisdiction.

If you use AI Kungfu on behalf of a company, organization, or client, you represent that you have authority to bind that entity to these Terms.

3. Accounts and Security

Some features require an account. You are responsible for:

  • Providing accurate account information.
  • Maintaining the confidentiality of your login credentials.
  • All actions taken through your account.
  • Keeping your email and authentication methods secure.
  • Promptly notifying us if you suspect unauthorized access.

We may suspend, restrict, or terminate accounts that violate these Terms, create risk, abuse the service, fail to pay fees, or are required to be restricted by law or service policy.

4. User Content

"User Content" means images, prompts, files, text, settings, instructions, feedback, and other materials you upload, submit, or provide to AI Kungfu.

You represent and warrant that:

  • You own or have all necessary rights, licenses, consents, and permissions for your User Content.
  • Your User Content does not violate law, contract, privacy rights, publicity rights, intellectual property rights, or third-party rights.
  • You have permission from any identifiable person whose image, likeness, or personal data you upload or use.
  • You will not upload sensitive, private, confidential, biometric, or third-party content unless you have a lawful basis and permission.

You retain ownership of your User Content. You grant AI Kungfu a limited, worldwide, non-exclusive license to host, store, process, transmit, display, reproduce, and use User Content as necessary to provide, operate, secure, support, troubleshoot, and improve the service.

5. Generated Outputs

"Generated Outputs" means videos, images, thumbnails, previews, metadata, or other results created by AI Kungfu or external AI processing services based on your User Content and prompts.

Subject to your compliance with these Terms, applicable law, third-party rights, service restrictions, and payment obligations, you may use Generated Outputs for lawful personal or commercial purposes.

You are solely responsible for:

  • Reviewing outputs before publication or commercial use.
  • Determining whether outputs are accurate, appropriate, lawful, and suitable for your intended use.
  • Obtaining any rights, releases, or permissions needed for people, brands, characters, music, trademarks, copyrighted works, or other third-party materials.
  • Complying with platform rules when publishing outputs to TikTok, YouTube, Instagram, X, ads platforms, marketplaces, or other channels.

AI Kungfu does not provide legal clearance, copyright review, trademark review, likeness clearance, model release verification, or rights management services.

Your use of Generated Outputs after creation is independent from AI Kungfu. You are solely responsible for how you download, publish, distribute, edit, sell, advertise, or otherwise use any Generated Outputs. AI Kungfu is not responsible for legal claims, platform actions, takedowns, disputes, losses, or damages arising from your use of Generated Outputs outside the service.

6. Acceptable Use

You agree not to use AI Kungfu to create, upload, request, distribute, or facilitate content that:

  • Violates any law, regulation, contract, court order, or third-party right.
  • Infringes copyright, trademark, trade secret, publicity, privacy, or other intellectual property rights.
  • Uses a real person's likeness without appropriate consent where consent is required.
  • Creates deceptive impersonation, fraud, scams, phishing, or misleading political or commercial content.
  • Contains non-consensual intimate imagery, sexual exploitation, child sexual abuse material, or sexual content involving minors.
  • Promotes harassment, threats, hate, self-harm, terrorism, unlawful violence, or criminal activity.
  • Uploads private images, identity documents, biometric data, or sensitive personal information without permission.
  • Attempts to bypass moderation, safety filters, rate limits, credit limits, payment controls, or security systems.
  • Scrapes, attacks, overloads, reverse engineers, resells, sublicenses, or interferes with AI Kungfu.
  • Uses generated outputs for unlawful surveillance, biometric identification, blackmail, extortion, or reputational harm.

We may block requests, remove content, refuse generation, limit features, suspend accounts, or report activity when we believe the service is being misused.

7. Third-Party Services

AI Kungfu may rely on third-party services for AI generation, authentication, hosting, storage, analytics, payments, email, security, and support. We do not list specific internal service providers in these Terms because our service stack may change over time.

Third-party services may have their own terms, policies, limits, outages, moderation systems, and retention practices. We are not responsible for third-party failures, delays, model behavior, policy decisions, or service interruptions.

References to third-party products, models, brands, characters, or technologies are for descriptive purposes only. AI Kungfu is independent and is not endorsed by or affiliated with any third-party brand unless explicitly stated.

8. Credits, Usage, and Paid Features

AI Kungfu may offer free trials, credits, one-time credit packs, subscriptions, paid plans, or other usage-based features.

Credits and paid features may be subject to:

  • Model-specific credit costs.
  • Resolution, duration, speed, or quality settings.
  • Queue priority or rate limits.
  • Expiration rules or validity periods.
  • Model availability and moderation outcomes.
  • Account, region, abuse prevention, or payment restrictions.

Credits are a limited license to use AI Kungfu features. Credits are not cash, stored value, currency, or a bank account balance and are not transferable unless we expressly allow it.

Failed tasks may be refunded automatically in credits when our system determines that a generation failed and credits were consumed. Automatic credit returns do not guarantee cash refunds.

9. Payments and Billing

If you purchase paid features, you agree to pay all fees shown at checkout. Prices may be listed in USD or another supported currency. Taxes, payment provider fees, bank fees, foreign exchange charges, or platform fees may apply.

Payments may be processed by third-party payment providers. We do not control payment processor approval decisions, bank timelines, chargeback processes, or card issuer policies.

You are responsible for keeping billing information accurate and for canceling subscriptions before renewal if you do not want to continue. Renewal charges may be non-refundable except as described in our Refund Policy or required by law.

10. Refunds

Refunds are governed by our Refund Policy.

In summary, a purchase may be eligible for a refund only if the request is submitted within 3 days of purchase and less than 5% of the purchased credits have been used. Additional exclusions apply.

11. Intellectual Property

AI Kungfu, including the website, software, code, interface, design, workflows, brand, logo, documentation, systems, and related technology, is owned by AI Kungfu or its licensors and is protected by intellectual property laws.

These Terms do not grant you ownership of AI Kungfu technology, software, trademarks, branding, models, or infrastructure. You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or exploit any part of the service except as expressly permitted.

12. Feedback

If you provide feedback, suggestions, ideas, bug reports, or feature requests, you grant us the right to use them without restriction or compensation. We are not required to treat feedback as confidential.

13. Service Availability and Changes

We may modify, update, suspend, limit, discontinue, or replace any part of AI Kungfu at any time. We may change models, pricing, credits, limits, features, or availability.

We do not guarantee uninterrupted access, error-free operation, permanent storage, specific generation speed, or continued availability of any model or feature.

14. Content Moderation and Enforcement

We may review, block, remove, restrict, or disable access to content, accounts, tasks, or outputs when we believe they violate these Terms, service rules, law, or safety requirements.

We may use automated systems, moderation, manual review, logs, user reports, and account signals to enforce these Terms.

15. Disclaimers

AI Kungfu is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability, and security.

We do not warrant that generated outputs will be unique, error-free, lawful for your intended use, commercially usable, free from third-party claims, or accepted by any platform.

16. Limitation of Liability

To the fullest extent permitted by law, AI Kungfu and its owners, operators, affiliates, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, business interruption, reputational harm, or loss of goodwill.

To the fullest extent permitted by law, our total liability for any claim related to AI Kungfu will not exceed the greater of:

  • The amount you paid to AI Kungfu in the 3 months before the event giving rise to the claim; or
  • USD $100.

Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.

17. Indemnification

You agree to defend, indemnify, and hold harmless AI Kungfu and its owners, operators, affiliates, employees, contractors, licensors, and service providers from any claims, damages, liabilities, losses, costs, and expenses arising from or related to:

  • Your use of AI Kungfu.
  • Your User Content.
  • Your Generated Outputs.
  • Your violation of these Terms.
  • Your violation of law or third-party rights.
  • Your publication, distribution, sale, or commercial use of outputs.

18. Termination

You may stop using AI Kungfu at any time. We may suspend or terminate your access if we believe you violated these Terms, created risk, abused the service, failed to pay fees, initiated fraudulent payments, or if continued access may expose us or others to harm or liability.

Termination does not eliminate obligations that should reasonably survive, including payment obligations, intellectual property protections, disclaimers, liability limits, indemnity, and dispute provisions.

19. Governing Law and Disputes

These Terms are governed by the laws applicable to the operator of AI Kungfu, without regard to conflict of law rules. Where local consumer protection laws require a different venue or governing law, those mandatory rights are not limited by these Terms.

Before filing a legal claim, you agree to contact us at support@aikungfu.app and attempt to resolve the issue informally.

20. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a new "Last updated" date. Continued use of AI Kungfu after changes means you accept the updated Terms.
